This document is an electronic record under the Information Technology Act, 2000 and the rules made under it. It is generated by a computer system and does not require a physical or digital signature.
Important: beware of fraud
SCOOBIES Fashion will never contact you offering cash prizes, lucky draws, franchise opportunities or rewards that require payment. We will never ask for your password, OTP, PIN, CVV or bank details by phone, email, SMS or WhatsApp. Any request to pay a fee or tax to claim a prize is a scam. Please make payments only through our official website. If you receive a suspicious message claiming to be from SCOOBIES, contact us at care@scoobiesfashion.com.

Welcome to SCOOBIES Fashion. The terms "we", "us" and "our" refer to SCOOBIES Fashion. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). SCOOBIES Fashion is powered by Shopify.
These Terms of Service ("Terms"), together with our Privacy Policy [LINK], Refund & Return Policy [LINK] and Shipping Policy [LINK], describe your rights and responsibilities when you use the Services. By visiting, browsing or purchasing from our store, you agree to these Terms. If you do not agree, please do not use the Services.
Section 1 – Eligibility
You may use the Services only if you are at least 18 years old and legally able to enter into a binding contract under the Indian Contract Act, 1872. Minors may use the Services only under the supervision of a parent or guardian who accepts these Terms.
Our Services are intended for customers in India, and we deliver only within India. If you access the Services from outside India, you are responsible for complying with your local laws.
Section 2 – Account and registration
You may be asked to provide information such as your name, email address, phone number, billing and shipping details. You agree that this information is true, accurate, current and complete, and you will keep it updated.
You are responsible for keeping your account credentials confidential and for all activity under your account. If you suspect unauthorised use, contact us immediately. We may suspend or terminate your account if we believe the information provided is false or that your account is being misused.
If you change the mobile number linked to your account, please update it promptly. We are not responsible for issues arising from a number that has been reassigned by your telecom provider.
Section 3 – Our products
We make every effort to display our products, colours and designs accurately. However, colours and appearance may vary depending on your device and screen settings, and we cannot guarantee an exact match.
Product descriptions, availability and prices may change without notice. We may discontinue any product or limit quantities per customer, household or region at our discretion.
Section 4 – Orders
All products listed on our website are an invitation to offer. When you place an order, you are making an offer to purchase. We will send you an email confirming that we have received your order. Your order is accepted only when it is dispatched.
We may decline or cancel any order at our discretion, including for limited stock, pricing or product errors, suspected fraud, or failed verification. If an order is cancelled after payment, we will refund the amount paid.
Your purchases are for personal or household use only and not for commercial resale.
Returns and exchanges are governed by our Refund & Return Policy [LINK].
Section 5 – Prices and payment
All prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise. Shipping, COD and any other charges will be shown at checkout before you pay.
While we try to keep prices accurate, errors may occur. If a product is listed at an incorrect price, we may contact you for instructions or cancel the order and refund any amount paid, even after confirmation.
You agree that the payment details you provide are accurate and that you are authorised to use the payment method. We may ask for additional verification (such as ID or address proof) before dispatching an order to confirm ownership of the payment method. We are not liable for any loss arising from a payment being declined by your bank or payment provider.
Section 6 – Offers, coupons and gift cards
Coupons and offers are valid only on eligible products, for the period stated, and while stocks last. Unless stated otherwise, a coupon can be used once per customer, cannot be combined with other coupons or offers, and cannot be exchanged for cash. We may modify or withdraw any offer at any time.
If you return part or all of an order placed with a coupon or offer, the offer benefit will not be included in the refund. For "Buy X Get Y" offers, all items in the offer must be returned together. Free gifts are not eligible for return, replacement or refund.
Gift cards can be redeemed only on our website for orders shipped within India. They cannot be redeemed for cash and cannot be replaced if lost or stolen.
Section 7 – Cancellations
By you: You can cancel an order before it is dispatched by emailing care@scoobiesfashion.com with your order number. We will refund the full amount paid. Orders that have already been dispatched cannot be cancelled; please refer to our Refund & Return Policy.
By us: We may cancel an order in the situations described in Section 4. We will notify you and refund any amount paid.
Section 8 – Shipping and delivery
Delivery timelines are estimates only and are not guaranteed. We are not responsible for delays caused by courier partners or events outside our control. Please refer to our Shipping Policy [LINK] for details. Risk of loss passes to you once the product is delivered to you.
If a delivery fails due to incorrect details provided by you, you may be charged for re-delivery.
Section 9 – Fraud and misuse
If we identify fraudulent use of the Services, including false return claims or payment fraud, we may cancel orders, suspend accounts, decline refunds, and take legal action to recover losses. Returned products are subject to verification, and we may decline a refund if the returned item does not match the original.
Section 10 – Reviews and feedback
Only customers who have purchased and received a product may review it. Reviews should be honest and relevant to the product. We may decline or remove reviews that contain promotional content, personal information, offensive language, references to other retailers, or content unrelated to the product.
By submitting reviews, photos, feedback or other content, you grant us a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, modify, publish and display that content for business and promotional purposes. You confirm that you have the right to share it and that anyone identifiable in your content has consented. You can request removal of your content by emailing care@scoobiesfashion.com.
Section 11 – Intellectual property
All content on the Services, including trademarks, logos, text, images, graphics, designs and their arrangement, is owned by SCOOBIES Fashion or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws.
You may use the Services for personal, non-commercial use only. You must not copy, reproduce, distribute, modify or commercially exploit any content without our written permission. Shopify's name and trademarks belong to Shopify. All other trademarks belong to their respective owners.
Section 12 – Optional tools and third-party links
We may provide access to third-party tools or links to third-party websites. We do not control or endorse them, and they are provided "as is". Your use of them is at your own risk and subject to their terms.
Section 13 – Relationship with Shopify
SCOOBIES Fashion is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with SCOOBIES Fashion. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and SCOOBIES Fashion, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with SCOOBIES Fashion.
Section 14 – Privacy
All personal information we collect is handled in accordance with our Privacy Policy [LINK], and certain information may be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, information you submit may be shared with Shopify and its service providers, which may be located outside India.
Section 15 – Electronic communications
By using the Services or emailing us, you consent to receive communications from us electronically, including by email, SMS or WhatsApp. You agree that electronic notices satisfy any legal requirement for written communication.
Section 16 – Prohibited uses
You may use the Services for lawful purposes only. You must not:
- Use the Services for any unlawful, fraudulent or harmful purpose, or to violate any law in force in India.
- Infringe our or anyone else's intellectual property rights.
- Harass, abuse, defame or harm any person, including our staff.
- Submit false or misleading information, or impersonate anyone.
- Upload viruses or malicious code, or attempt to breach the security of the Services.
- Send spam or unsolicited promotional material.
- Scrape, copy or collect data from the Services using bots, scripts or AI tools.
- Interfere with any other person's use of the Services.
We may suspend or terminate your access if you violate these Terms.
Section 17 – Agents
17.1 This section applies if you use, enable or deploy an Agent to access or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of any person without direct supervision.
17.2 No Agent may access or interact with the Services unless it identifies itself and complies with Section 17.4 at all times, or if we have asked it to refrain.
17.3 We may limit, including by technical measures, how any Agent accesses or interacts with the Services.
17.4 Agents must identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string. They must not conceal that they are an Agent, mimic human behaviour, bypass CAPTCHAs, answer untruthfully when asked whether they are human, or circumvent any measure we use to control Agent access.
Section 18 – Termination
We may terminate these Terms or your access to the Services at any time without notice. You remain liable for any amounts owed. Sections relating to intellectual property, feedback, disclaimers, limitation of liability, indemnity and governing law survive termination.
Section 19 – Disclaimer of warranties
The Services and products are provided on an "as is" and "as available" basis, to the fullest extent permitted under applicable Indian law. We do not guarantee that the Services will be uninterrupted, secure or error-free. This does not affect any rights you have under the Consumer Protection Act, 2019 or any manufacturer's warranty stated on the product.
Section 20 – Limitation of liability
To the fullest extent permitted by law, SCOOBIES Fashion, its partners, employees, affiliates and service providers (including Shopify) will not be liable for any indirect, incidental, special or consequential damages, including loss of profits, data or goodwill, arising from your use of the Services or any product.
Our total liability to you for any claim relating to an order is limited to the amount you paid for the product concerned.
Section 21 – Indemnity
You agree to indemnify and hold harmless SCOOBIES Fashion, Shopify and their affiliates, employees and service providers from any claims, losses, liabilities or expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law or third-party rights, or your use of the Services.
Section 22 – Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, government action, strikes, riots, war, courier disruptions, or failures of internet or payment systems.
Section 23 – General
Severability: If any provision is found unenforceable, the rest of these Terms remain in effect.
Waiver: Our failure to enforce any right is not a waiver of that right.
Entire agreement: These Terms and the policies referenced in them form the entire agreement between you and us and supersede any prior versions.
Assignment: You may not transfer your rights under these Terms without our written consent. We may assign our rights without notice to you.
Headings: Headings are for convenience only and have no legal effect.
Section 24 – Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
Section 25 – Changes to these Terms
We may update these Terms at any time by posting the revised version on this page. Material changes will be notified as required by law. Continued use of the Services after changes are posted means you accept the updated Terms.
